Christensen & Prezeau, PLLP, evolved from the long-standing and well-respected law firm of Hughes, Kellner, Sullivan, and Alke. Formed by partners Amy Christensen and Cherche Prezeau in 2015, Christensen & Prezeau, PLLP, has seamlessly continued the tradition created decades ago of providing award-winning legal counsel and representation to businesses, governmental agencies, health care organizations, nonprofit corporations, and individuals throughout Montana.
Our legal advice and litigation strategies are based on a combination of acumen, pragmatism, and years of experience. Our attorneys are experienced counselors and litigators, capable of resolving disputes in court, administrative proceedings, and alternate dispute resolution. We also believe that preventative advice is more cost-effective for a client than defending litigation, and we strive to develop client relationships that encourage discussion and proactive compliance to help avoid litigation when possible.
We have developed a reputation for thorough preparation, persuasive advocacy, and a track record of results. In every situation, we strive to achieve one simple goal: securing the best possible result for our clients.
Christensen & Prezeau’s experienced attorneys regularly advise employers in ways to manage employee performance issues, prepare legally compliant personnel policies, appropriately document personnel matters, and minimize risk. We regularly counsel management clients on issues relating to wrongful discharge, discrimination and harassment, retaliation, wage and hour, FMLA, unemployment insurance, and other types of employment matters. Our proactive approach to working with clients helps to avoid litigation in the first instance. When that is not possible, our guidance helps employers be better prepared to defend employment-related claims. We provide employment litigation defense in state and federal court and before administrative agencies. We also review employment contracts and conduct investigations into allegations of hostile work environment and other workplace disputes.
The firm represents contractors, owners, developers, architects, engineers, subcontractors, and suppliers, providing both construction-related advice and litigation services. Our firm has extensive experience in the preparation and review of construction contracts and construction liens, administrative and licensing issues, and negotiation and litigation of disputes involving defective construction, contract disputes, and delay and collection issues. We also serve as panel counsel for several national insurance companies, providing representation to contractors and design professionals in construction-related litigation.
We represent businesses and individuals in commercial litigation in Montana federal and state courts, with an emphasis on defense. Our experience includes all facets of general business and commercial litigation, including breach of contract, personal injury, product liability, and tort defense. Additionally, we serve as panel counsel for several national insurance companies, providing representation to insureds in civil litigation.
Our attorneys represent clients in many areas, including commercial and residential real estate acquisitions and sales; subdivision review and regulation; zoning and land use issues; easement disputes; and the development, review, and enforcement of subdivision covenants. Our firm regularly coordinates with city and county planning departments and appropriate state agencies and appears before governmental review bodies at the local and state level. We have represented clients in state and federal courts and have successfully appeared before the Montana Supreme Court on several land use issues.
Christensen & Prezeau, PLLP, represents health care providers across Montana, including community and specialty hospitals, physician clinics, and individual practitioners. We regularly advise providers on compliance with privacy requirements under state and federal law, including HIPAA and the HITECH Act. We work with providers to strengthen their privacy policies and help them navigate audits by the Office of Civil Rights. We also provide advice regarding compliance issues related to research, including informed consent and Institutional Review Board requirements, and we defend health care practitioners before administrative licensing boards.
In addition to our litigation expertise, Christensen & Prezeau has the depth of experience to handle appeals in the Montana Supreme Court and in the Federal Courts of Appeal in even the most complicated cases. With the addition of Stuart Segrest, who has handled over forty appeals in the Montana Supreme Court (with three oral arguments) and five appeals in the Ninth Circuit (three as first chair), the firm is well-positioned to provide top-rate appellate advocacy. In addition to handling direct appeals, the firm can assist with brief writing or editing, aid with oral argument preparation, and draft amicus briefs for clients who want their voices heard on important cases.
